SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS covering the European Union’s intention to revise its food contact plastics regulation.
The World Trade Organization (WTO) shared the EU’s draft document on January 23, 2023. It contains several important changes to Table 1 (union list/positive list) and Table 2 (group restriction of substances) in Annex I of Regulation (EU) 10/2011.
Among the proposed changes are:
– Nine food contact materials (FCM) replaced because of strengthened migration limits or new requirements
– Five new entries
– Three entries in group restriction of substances replaced
– Three new entries to group restriction of substances
SGS has published SafeGuardS 013.23 to help stakeholders gain a better understanding of the changes being proposed. In addition to more details on the proposed changes listed above, it also includes details of revoked authorizations for some FCM and a table highlighting the restriction of four phthalates – dibutyl ester (DBP), benzyl butyl ester (BBP), bis(2-ethylhexyl) ester (DEHP) and diesters with primary, saturated C8-C10 branched alcohols, more than 60% C9 (DINP).
Interested parties are advised to review SGS’s original SafeGuardS 013.23.
The proposal allows food contact plastics that comply with the current regulation, and which were placed onto the market before 18 months after the entry into force of the amendment, to remain on the market until stocks are exhausted.
The draft document contains the following dates:
– Adoption – March 31, 2023
– Publishing – April 3, 2023
It will then be brought into force twenty days after publication in the Official Journal of the EU (OJEU).
