SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS looking at New York state’s recently approved legislation relating to carpet recycling.
S05027-C/A09279A carpet extended responsibility legislation requires all manufacturers of carpets selling their products within the state to engage in an approved industry-wide recycling plan or establish their own carpet collection program, which must also be approved by the state’s Department of Environmental Conservation.
After January 2026, carpet manufacturers will no longer be able to operate in the state unless they have an approved, reliable mechanism for consumers to recycle discarded and unused carpeting. The aim is to reduce landfill and encourage recycling into new carpets and other products.
SGS has published SafeGuardS 040.23 to help stakeholders understand the implications of the new legislation. This includes the way carpet is defined in Bill A09279A, mandatory goals that have been set for recycling and the penalties that noncompliant manufacturers will face. There are also details of the new requirements relating to per- and polyfluoroalkyl substances (PFAS) – ban beginning January 2025.
