Proposal to Regulate PFAS in Products in the US State of Maine

Geneva (January 24, 2025) – SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 007.25, summarizing Maine’s Department of Environmental Protection’s proposed rule to implement its ‘Products Containing PFAS’ law.

The law aims to protect human, animal and environmental health from per- and polyfluoroalkyl substances (PFAS), so-called ‘forever chemicals’. It was originally enacted in July 2021 and revised in April 2024. Various sales prohibitions for products containing PFAS and reporting requirements in cases of currently unavoidable use (CCU) have been included.

The proposed new rule, 38 MRSA §1614, filed under Chapter 90: Products Containing Per- and Polyfluoroalkyl Substances’ was announced in December 2024 and is open for comments until January 28, 2025. Among the important provisions that the proposed rule would implement are:
– Additional definitions, such as ‘consumer products’, ‘electronics’ and ‘resilient floor covering’
– Additional explanations to definitions given in the law, such as ‘cookware product’ and ‘cosmetic product’
– Further details for reporting requirements for products subjected to a CUU determination
