SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that the United Kingdom has revised its chemical requirements for toys destined for markets in Great Britain (England, Scotland and Wales).
The UK issued SI 2022 No. 659 on June 16, 2022. It will amend:
- Toys (Safety) Regulations 2011
- Cosmetics Regulations 1223/2009
Provisions include:
- Expansion in the number of allergenic fragrances (55 to 58) by adding:
- Atranol
- Chloroatranol
- Methyl heptine carbonate (deleted from Schedule 2, Part 3, Point 11, Table 2)
- Strengthening the migration of aluminum 2.5-fold for all three categories of toy materials (Schedule 2, Part 3, Point 13)
- Restricting aniline and formaldehyde in certain toys/toy materials
Stakeholders should be aware the presence of the three new prohibited allergenic fragrances is allowed if they are technically unavoidable under good manufacturing practice (GMP) and each fragrance is no more than 100 mg/kg
SI 2022 No. 659 further aligns GB’s chemical requirements on toy safety with those in Directive 2009/48/EC, the so-called European Toy Safety Directive (TSD). It is interesting to note that the UK has not implemented the 61 new entries of allergenic fragrances from Directive (EU) 2020/2088 into UK law for toys in this amendment.
The important effective dates for toys are:
- October 15, 2022 – provisions other than those specified below
- December 15, 2022 – migration of aluminum and requirements for aniline and formaldehyde
Toys that are compliant and placed on the market before the effective dates in the latest revision may remain on the market until stocks are exhausted.
