EU Updates Food Contact Plastics Regulation

The European Union (EU) has published a
new regulation – Regulation (EU) 2020/1245 – that will amend and correct
Regulation (EU) 10/2011 ‘Food Contact Plastics Regulation’.

Regulation (EU) 2020/1245 contains a number of important changes,
including a completely new Table 1 in Annex II ‘Restrictions on plastic
materials and articles’. Table 1 defines the specific migration limits (SML)
for 19 substances that are subject to specific conditions. These are aluminum,
antimony, arsenic, barium, cadmium, chromium, cobalt, copper, europium, gadolinium,
iron, lanthanum, lead, lithium, manganese, mercury, nickel, terbium, and zinc.

It also contains five substances with migration limits subject to
Articles 11(3) and 12: ammonium, calcium, magnesium, potassium, and sodium.

Among the other provisions in Regulation (EU) 2020/1245 are
changes to:

  • Annex I,
    Table 1 ‘Union list of authorized substances’
  • Annex IV ‘Declaration of Compliance’
  • Annex V ‘Compliance Testing’

The new law will come into force on
September 23, 2020.

Products that conform to the current Food
Contact Plastics Regulation, and which are placed onto the market before March
23, 2021, can continue to be placed onto the market until September 23, 2022.
They can then remain on the market until stocks are exhausted.
