Brazil Updates Food Contact Materials and Articles Legislation

SGS, the world’s leading testing, inspection and certification company, is reminding stakeholders that Brazil has revised its legislation relating to food contact materials and articles.

Brazil’s Ministry of Health/National Health Surveillance Agency (ANVISA) published Resolution of the Collegiate Board of Directors No. 589 of December 20, 2021, in December 2021. This transposes GMC/Mercosur Resolution Nos. 19/2021, 20/2021 and 21/2021 into national law, thereby updating the following pieces of legislation:

  • Resolution No. 105/1999 ‘General provisions for food contact plastics’
  • Resolution RDC No. 56/2012 ‘Positive list for food contact plastics’
  • Resolution RDC No. 88/2016 ‘Food contact cellulosic materials and articles’

Among the changes brought in by the updates are amendments to:

  • Overall migration requirements
  • Specific migration requirements for primary aromatic amines (PAA)
  • Requirements for container coatings
  • Restrictions/specifications for 11 substances, including bisphenol A (BPA)

The new resolution came into force on January 3, 2022, and its provisions will become effective one year thereafter.
