SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 142.24 to keep stakeholders informed about plans by the US Environmental Protection Agency (EPA) to delay reporting timeframes for manufacturers and importers of per- and polyfluoroalkyl substances (PFAS), and articles containing PFAS.
The ‘Toxic Substances Control Act Reporting and Recordkeeping Requirements for Perfluoroalkyl and Polyfluoroalkyl Substances’ (‘TSCA PFAS Reporting Rule’) was signed into effect on September 28, 2023. This requires businesses involved in the manufacture or import of designated PFAS compounds, including products containing designated PFAS, between January 1, 2011, and December 31, 2022, to submit a report to the EPA by established deadlines.
The direct final rule (DFR) issued on September 5, 2024, will, if adopted, delay these reporting timeframes by eight months. For general businesses, this would mean a submission period of July 11, 2025, to January 11, 2026, and for small businesses July 11, 2025, to July 11, 2026.

Stakeholders have until October 7, 2024, to send comments to the EPA. If no adverse comments are received by this date, the DFR will come into effect on November 4, 2024, and the new submission dates will come into effect.
