The European Commission (EC) has published a draft
proposal to limit pentachlorophenol (PCP), its salts and esters, to no more
than 5 mg/kg.
The proposal is being made under an amendment to
Regulation (EU) 2019/1021 on persistent organic pollutants (recast), referred
to as ‘the POP Recast Regulation’. If
accepted the proposal will set the limit in Part A of Annex I.
When the regulation was originally published PCP, its
salts and esters were listed without an Unintentional Trace Contaminant (UTC)
limit value. Since then, the Commission has determined these substances are an
impurity in some articles, including imported textiles and recovered wood chips
for the manufacture of wood panels.
The new defined limit of 5 mg/kg will, if accepted,
facilitate enforcement without negatively impacting the recycling of wood
chips.
The Pop Recast Regulation was originally published in
June 2019. Since then, Part A of Annex I has been amended multiple times.
Changes include the:
- Addition of perfluorooctanoic acid (PFOA), its salts
and PFOA-related compounds - Replacing an existing
derogation on perfluorooctane sulfonic acid and its derivatives (PFOS) as a
mist suppressant for non-decorative hard chromium (VI) plating in closed loop
systems - Addition of the
pesticide dicofol

The Commission is accepting comments on the proposal
until September 29, 2020. If accepted, it will come into effect twenty days
after it is published in the Official Journal of the European Union (OJEU).
This could be in late 2020 or early 2021.
