SGS, the world’s leading testing, inspection and certification company, is informing stakeholders that the US state of New York has expanded regulatory measures covering flame retardants in consumer products.
The State Governor signed S4630B (companion A5418B) – ‘Family and Fire Fighter Protection Act’ – into law on December 31, 2021. It adds a new Title X to Article 37 of the state’s Environmental Conservation Law and aims to regulate flame retardants in:
- Upholstered and reupholstered furniture
- Mattresses
- Electronic display enclosures and stands
Stakeholders should be aware the following are exempt:
- All-in-one video conference systems
- Displays that are integrated with appliances and are not available for purchase as separate products by end-users
- Electronic displays with a screen no more than 100 cm²
- Projectors and virtual reality headsets
The following flame retardants are being regulated:
- Halogenated
- Organophosphorus
- Organonitrogen
- Nanoscale chemicals
- Organo-halogen
Stakeholders should be aware the state also regulates the following flame retardants:
- Pentabrominated diphenyl ether (penta-BDE) and octabrominated diphenyl ether (Octa-BDE) in consumer products
- Tris(2-chloroethyl) phosphate (TCEP) and tris(1,3-dichloro-2-propyl) phosphate (TDCPP) in childcare products, including toys, for children under three years of age
The Act defines ‘intentionally added’ as meaning ‘intentionally added chemical’ as defined under Section 37-0901.11 – a chemical in a product that serves an intended function in the product component.
This law will be implemented in phases, starting on December 31, 2022.
