SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS detailing Turkey’s intention to revise its Food Codex Communiqué on food contact plastics.
The revised draft amendment implements two amendments to the European Union’s Regulation (EU) 10/2011 on food contact plastics. These are:
– Regulation (EU) 2020/1245 (amendment 15 to Regulation (EU) 10/2011) – changes include provisions relating to 1,3-phenylenediamine, (FCM no 236), antimony trioxide (FCM no 398), several authorized substances, primary aromatic amines (PAA), a table defining the specific migration limit (SML) of 19 substances and an additional five substances where their migrations are subject to certain conditions and requirements for repeated use articles
– Regulation (EU) 2023/1442 (amendment 16) – an important revision which, among other things, delists two substances, adds and replaces several authorized substances and provides new specifications for several phthalates
Turkey’s revised draft amendment was circulated by the World Trade Organization (WTO) on September 4, 2023, attached to WTO document number 23-5884 and notified under G/TBT/N/TUR/135/Add.1
Stakeholders should be aware the revised draft amendment contains two important dates:
– Date of entry into force = date of publication
– Date of applicability = January 1, 2026
Food contact plastics placed onto the market before January 1, 2026, but which do not comply with the amendment, can remain on the market until January 1, 2028.
