SGS Helps Manufacturers of Food Contact Glass and Ceramics Understand Proposed Colombian Regulation

SGS
expert, Dr. HingWo Tsang, has published an overview of Colombia’s draft
resolution signalling its intention to establish a Technical Regulation for the
migration of lead and cadmium in food contact glass and ceramics.

The
World Trade Organization (WTO) announced this draft resolution from the
Colombian Ministry of Health and Social Protection on April 13, 2021. It covers:

  • Tableware,
    kitchenware and articles of glassware, ceramic or glass-ceramic that come into
    contact with food
  • Ceramic
    ware for cooking food

It
applies to products that are manufactured, imported and/or marketed in
Colombia.

Provisions
included in the draft resolution include:

  • List
    of HS codes for products within the scope of the regulation
  • Products
    that are exempted – articles for decorative purposes, etc. – which must carry the
    warning, ‘Producto decorativo, no apto para contacto con
    alimentos’ (    ‘Decorative
    products, not suitable for food contact’)
  • Standards
    and migration requirements for lead and cadmium
  • Details
    of the labeling requirements (in Spanish), including year and month of
    manufacture
  • Requirements
    relating to sampling by a Certified Body (CB), Certificate of Conformity (CoC),
    and laboratory testing

The
draft resolution includes the following important timeline dates:

  • Six-month
    transition period to sell to consumers for:

    1. Domestically
      manufactured products with inventory between January 17, 2021 and the date of
      entry into force
    2. Imported
      products with sales invoice between January 17, 2021 and the date of entry into
      force
  • Products
    not sold within this timeframe must conform to the new requirements

The
draft resolution also states that these provisions will come into effect six
months after they are published in the Official Journal.

Stakeholders

compliant.
