SGS Highlights Rhode Island Regulation of PFAS in Certain Consumer Goods

SGS, the world’s leading, inspection and certification company, has published a summary of the US state of Rhode Island’s regulation of per- and polyfluoroalkyl substances (PFAS) used in several categories of consumer products.

S 2152/H 7356 became effective on June 26, 2024, creating Chapter 18.18 to Title 23 of the state’s General Laws. Under the terms of the act, PFAS are forbidden if intentionally added. The exemption is outdoor apparel for severe weather, where they are prohibited unless accompanied by the statement, ‘Made with PFAS chemicals.’

The prohibition relates to:
– Artificial turfs
– Carpets and rugs
– Cookware
– Fabric treatments
– Juvenile products
– Ski wax
– Textile articles
– Outdoor apparel for severe wet conditions

Stakeholders should be aware, second-hand products are also exempted.

SGS experts publish SafeGuardS to keep stakeholders informed about regulatory changes that could impact their business. SafeGuardS 106.24 covers Rhode Island’s new regulation on PFAS and includes the act’s definitions for:
– Apparel
– Artificial turf
– Carpets or rugs
– Cookware
– Juvenile products
– Manufacturer
– Perfluoroalkyl and polyfluoroalkyl substances (PFAS)

Stakeholders are advised to review SGS’s original SafeGuardS 106.24 for more information, including links to relevant documents.

The provisions of the act will come into effect on January 1, 2027, except for the requirements for outdoor clothing for severe wet conditions, which will come into effect on January 1, 2029.
