SGS Publishes Overview of New Chemical Regulations for Products in Minnesota

SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS to help stakeholders understand new rules in Minnesota, USA, regulating perfluoroalkyl and polyfluoroalkyl substances (PFAS) and two heavy metals (lead and cadmium) in consumer products.

Minnesota’s governor signed HF 2310 (Chapter 60, 2023) into law on May 24, 2023. This is an omnibus environment and natural resources bill that sets budget appropriations relating to agencies with a wide array of provisions relating to environmental matters.

Restrictions relating to PFAS will be implemented in phases, starting on January 1, 2025. The restrictions relating to lead and cadmium do not have an effective date but, per 2022 Minnesota Statute Section 645.02, a law without a provided effective date will take effect on the August 1 following its final enactment. It can therefore be assumed the effective date will be August 1, 2023.

SGS has published SafeGuardS 066.23 to provide stakeholders with a helpful overview of the new regulations. In addition to a breakdown of the provisions and scope of the new regulations, the SafeGuardS also includes the law’s definitions for cleaning product, cookware, juvenile products and PFAS.
