SGS Publishes Summaries of Multiple California Prop 65 Reformulation of Phthalates Settlement Agreements

SGS has publishes a SafeGuard detailing multiple settlement agreements reached in California in relation to the use of phthalates in consumer goods.

As part of the SafeGuard, SGS expert Dr HingWo Tsang has created tables that outline the agreements reached for a wide variety of consumer products – from handle grips and bike storage racks to sports armbands and witches’ hats.

Passed in November 1986, Prop 65, or the ‘Safe Drinking Water and Toxic Enforcement Act of 1986’, is a unique piece of legislation that requires the state to maintain a list of chemicals (Prop 65 List) known to cause cancer, birth defects and/or reproductive harm. Unless exempted, businesses operating in California must provide ‘a clear and reasonable warning’ (Prop 65 Warning) before knowingly and intentionally exposing anyone to a substance on the Prop 65 List. Once a substance is included in the list, companies have twelve months to comply with this requirement.

The Prop 65 List now contains more than 900 substances, including six phthalates:

  • Di(2-ethylhexyl) phthalate (DEHP) – listed 1988
  • Butyl benzyl phthalate (BBP) – listed 2005
  • Di-n-butyl phthalate (DBP) – listed 2005
  • Di-n-hexyl phthalate (DnHP) – listed 2005
  • Di-isodecyl phthalate (DIDP) – listed 2007
  • Diisononyl phthalate (DINP) – listed 2013

To learn more about these settlement agreements, read SGS’s original SafeGuard 010/22.

Settlement agreements are only legally binding to named parties.
