SGS Summarizes Revisions to Vermont Law on Products Containing PFAS and other Chemicals

SGS, the world’s leading testing, inspection and certification, has published SafeGuardS 086.24 to provide stakeholders with an overview of the US state of Vermont’s revisions to its law regulating per- and polyfluoroalkyl substances (PFAS) and other chemicals in consumer products.

The original measures were approved in May 2021, revising 18 V.S.A of the state’s statutes by adding several chapters and amended § 1773 in relation to chemicals of high concern to children (CHCC). On May 30, 2024, these measures were amended with the signing into law of S25. This act will become effective on July 1, 2024, with its provisions being implemented in phases from that date.

Products covered by the amendment include:
– Aftermarket stain and water-resistant treatments for rugs and carpets
– Artificial turfs
– Cookware
– Incontinency protection products
– Juvenile products
– Ski wax
– Residential rugs and carpets
– Textiles and textile articles
– Class B firefighting foam
– Personal protective equipment (PPE)
– Food packaging

In addition to PFAS, the amendments also relate to bisphenols and ortho-phthalates.

In addition to information on the different terms and definitions include in the act, it also includes a table highlighting several important provisions in S25, including scope, requirement and effective date.

Stakeholders should be aware the following Vermont laws with be repealed on January 1, 2026:
– 18 V.S.A Chapter 33 (PFAS in firefighting agents and equipment)
– 18 V.S.A Chapter 33A (chemicals of concern in food packaging)
– 18 V.S.A Chapter 33B (PFAS is rugs, carpets, and aftermarket stain and water-resistant treatments)
– 18 V.S.A Chapter 33C (PFAS in ski wax)
