SGS Summarizes US Proposal to Ban Certain Food Contact Substances

SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS to keep stakeholders up to date with US moves prohibit several chemicals and classes of chemical from food contact materials and articles.

The US government has introduced H.R 6105 ‘No Toxics in Food Packaging Act of 2023’ to prohibit the following substances:
– Antimony trioxide
– Bisphenol A, B, S, F, AF or related compounds
– Ortho-phthalates
– Per- or polyfluoroalkyl substances (PFAS)
– Styrene

If accepted, the proposed act will amend Section 409 of the Federal Food, Drug and Cosmetic Act (21 U.S.C 348).

SGS has published SafeGuardS 150.23 to provide an overview of the proposal. Additional details included in the SafeGuardS are a definition of PFAS and examples of ortho-phthalates. It also explains how the bill outlines that alternatives used in place of prohibited substances should be considered for potential adverse effects against vulnerable populations.

Stakeholders are advised to review SGS’s original SafeGuardS 150.23 for more information.

The proposed act was introduced in October 2023. It will become effective two years after the date of enactment.
