Ukraine has published a draft law that, if
adopted, will introduce a number of different provisions relating to food
contact materials and articles.
Published by the Ukrainian Ministry of
Economic Development, Trade and Agriculture in May 2020, the proposed law
includes specific measures relating to 17 groups of food contact materials and
articles. These groups are:
- Active and intelligent materials and articles
- Adhesives
- Ceramics
- Cork
- Rubber
- Glass
- Ion-exchange resins
- Metals and alloys
- Paper and board
- Plastics
- Printing inks
- Regenerated cellulose
- Silicones
- Textiles
- Varnishes and coatings
- Wax
- Wood
The draft legislation also includes
general requirements and specific provisions relating to:
- Safety
- Declaration of Conformity (DoC), traceability and labeling, including the use of the ‘glass and fork’ and ‘DO NOT EAT’ symbols
- Recycling of plastic materials and articles
- Good manufacturing practice (GMP), including rules for printing inks
- State regulation for the production and circulation of food contact materials and articles (state registration, Section III)
Ukraine’s draft law is modeled on several
pieces of European Union (EU) legislation relating to food contact materials
and articles. These include:
- Regulation
(EC) 1935/2004 ‘Framework Legislation’ - Regulation (EC) 450/2009 ‘Active and Intelligent Materials and Articles’
- Regulation (EC) 2023/2006 ‘Good Manufacturing Practice (GMP)’
- Regulation (EC) 282/2008 ‘Recycled Plastics’
The draft legislation states that the law
will come into effective six months after it is published.
Stakeholders should be aware that the law
allows the use of food contact materials and articles that have been approved
in the EU until specific measures have been approved for Article 6 ‘Special
measures for groups of materials and articles’.
