SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS summarizing a recent note from the US Consumer Products Safety Commission (CPSC) reminding stakeholders about the enforcement of Reese’s Law.
Named after Reese Hamsmith, a Texan toddler who died after swallowing a button battery, Reese’s Law aims to reduce incidents of children ingesting button cell and coin batteries.
With the date of enforcement for sections 2 and 3, following enforcement discretions, fast approaching, the CPSC’s Office of Compliance and Field Operations has sent out a letter reminding stakeholders of the new requirements.
These are:
– March 8, 2024 – zinc-air button cell or coin battery packaging must meet 16 CFR 1700.15
– March 19, 2024 – consumer products containing or designed to use button cell or coin batteries must meet the performance and labeling requirements in 16 CFR 1263
The letter was issued on February 12, 2024. At the current time, additional extensions to enforcement discretions have not been accepted.
Stakeholders should also be aware that the final rule (16 CFR 1263.4), establishing labeling requirements for button cell or coin battery packages, will become effective on September 21, 2024.
