New Brazilian Ordinance for Baby Walkers

Brazil’s new Ordinance for baby walkers came into
effect on April 1, 2021, thereby repealing INMETRO Ordinance 42/2018.

INMETRO Ordinance No. 129 of March 19, 2021 contains Brazil’s consolidated technical
regulations and conformity assessment requirements for baby walkers. Provisions
in the Ordinance include:

  • Establishing the consolidated regulation for baby
    walkers in the form of quality technical regulations (Annex I), conformity
    assessment requirements (Annex II) and specifications for the conformity
    identification seal (Annex III) – suppliers may choose Certification Model 2, 5
    or 1b for conformity assessment requirements
  • Clarification that the scope does not include baby
    walkers for therapeutic and curative purposes
  • Requiring (certified) baby walkers to be registered
    with INMETRO
  • Stating that baby walkers falling under the scope of
    the Ordinance are subject to market surveillance activities by INMETRO and
    other public enforcement agencies
  • Requiring suppliers to
    furnish the required information within 15 days when requested by INMETRO

Complementary standards for conformity include:

  • ABNT NBR NM 300-1:2011 Toy Safety – Part 1: General,
    mechanical and physical properties
  • ABNT NBR NM 300-2:2004 Toy Safety – Part 2:
    Flammability
  • ABNT NBR NM 300-3:2011 Toy Safety – Part 3: Migration
    of certain elements
  • ABNT NBR 300-6:2004 Toy Safety – Part 6: Electric toy
    safety
  • ABNT NBR 5426:1985 Sampling plans and procedures for
    attribute inspection
  • ABNT NBR 16311:2014 Baby walkers – Safety requirements
    and test methods

Manufacturers and suppliers of baby walkers for the
Brazilian market are now advised to check their products conform to the current
Ordinance. Products with certification against Ordinance 42/2018 will require
assessment against the new Ordinance at their next evaluation.
