SGS Advises Stakeholders of Maine’s Draft Rule for Products Containing Intentionally added PFAS

SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that the US state of Maine has issued a draft rule pertaining to products containing intentionally added per- or polyfluoroalkyl substances PFAS.

LD 1503 (Chapter 477) was signed into law in 2021, codifying 38 M.R.S. §1614 ‘Products Containing PFAS’.

Provisions include:

– Manufacturers of products (includes importers and companies whose brand name is affixed to the product by statute) containing intentionally added PFAS required to submit a notification to the Department of Environmental Protection (DEP) from January 1, 2023
– Carpets, rugs and fabric treatments prohibited from containing intentionally added PFAS from January 1, 2023
– Prohibits products containing intentionally added PFAS from January 1, 2030, unless the DEP has determined by rule that the use of PFAS is currently unavoidable

The Maine DEP issued a draft rule on February 14, 2023 – Chapter 90: Products Containing Perfluoroalkyl and Polyfluoroalkyl Substances’. If accepted, this will provide additional guidance on notification requirements and sale prohibitions relating to product containing intentionally added PFAS.

SGS has published SafeGuardS 028.23 to give stakeholders an overview of the proposed rule, including a list of the important provisions within it. Interested parties are advised to review the original SafeGuardS to ensure they stay up to date with the latest developments.

The Maine DEP will accept comments on the proposal until May 19, 2023.
