SGS Publishes SafeGuardS Covering Recent Developments in EU Classification of Titanium Dioxide

SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that the French Government is to appeal the European Union (EU) General Court’s decision to annul the classification of titanium dioxide (TiO2) in certain powder forms as carcinogenic.

In November 2022, the Court of Justice of the European Union (CJEU) annulled a 2019 Commission Delegation concerning the classification of TiO2 in powder form containing 1% or more of particles with aerodynamic diameters less than or equal to 10µm as a carcinogenic category 2 substance by inhalation.

On February 13, 2023, the France’s Ministry of Ecological Transition and Territorial Cohesion and Ministry of Energy Transition announced they intended to appeal this judgement.
