SGS Summarizes Revisions to EU Food Contact Plastics Regulation

SGS, the world’s leading testing, inspection and certification company, has published a summary of recent revisions to the European Union (EU) Food Contact Plastics Regulation.

Commission Regulation (EU) 2023/1442 was published on July 12, 2023. It amends Tables 1 (Union List) and 2 (Group restriction of substances) in Annex I of Regulation (EU) 10/2011, the Food Contact Plastics Regulation.

Among the changes in the latest revision are:

– Two food contact materials (FCMs) delisted
– Nine FCM substances replaced
– Five new substance entries added
– Three entries in group restrictions replaced
– Three new groups inserted

SGS has published SafeGuardS 089.23 to help stakeholders understand the breadth of these amendments so they can ascertain the impact on their business. It includes a complete breakdown of the insertions, deletions and revisions in the two tables as well as information on the changes affecting a variety of phthalates.

The amendment will enter into force on August 1, 2023. Products in compliance with the current Food Contact Plastics Regulation that are placed onto the market before February 1, 2025, can remain on sale until stocks are exhausted.

Stakeholders should also be aware food contact plastics manufactured with salicylic acid or untreated wood flour or fibers from a specific wood species can still be first placed onto the market after February 1, 2025, subject to defined conditions. This includes the requirement to submit an application for authorization before August 1, 2024.
